By continuing to use this Site and/or AM/PM Shuttle Service, LLC services, you agree to be bound by the following Terms of Use (the “Agreement”) without limitation or qualification; therefore, please read the following carefully before proceeding as this Agreement is legally binding. If you do NOT agree with any part of this Agreement, please do not access and/or use this Site and/or our Services in any manner. These Terms of Use, together with our Privacy Policy and Customer Agreement, constitute the entire agreement between you and us, superseding any and all prior or inconsistent understandings, representations or agreements regarding the Services. We may add, delete or modify any of our Services at any time in our sole discretion. We may similarly change this Agreement at any time and without notice. Changes will take effect once we post these changes on the Site (“effective date”). Any revisions or changes are binding on you; therefore, it is recommended that you periodically visit this page when you use the Site to review the Agreements that bind you. If any change is not acceptable to you, you must stop using the Services. Your use of the Services after the effective date shall constitute your acceptance of such changes. If any new products or services become available, they will be considered a part of the Services and your use of them will be governed by the terms and conditions of this Agreement unless we notify you that different terms and conditions apply.

Terms of Use
By using the site, you represent and warrant that you are 18 years of age or older and possess the legal ability to agree to the terms of this Agreement. You also agree to indemnify, defend, and hold harmless, AM/PM Shuttle Service, LLC and its affiliates from and against any and  all claims, demands, proceedings, suites, and actions arising from your use of this Site and/or our Services.


This Site may contain inaccuracies and/or typographical errors. AM/PM Shuttle Service, LLC makes no warranties as to the completeness or accuracy of the content of this Site. The use of the Site is at your own risk. The content of the Site is “as is”, and without warranty of any kind either expressed or implied, including without limitation, any implied warranties of expectation of privacy, fitness for a particular purpose, merchant-ability, non-infringement, or  title. In no event will AM/PM Shuttle Services, LLC or its affiliates be liable for any damages whether consequential, direct, incidental, indirect, or otherwise, arising from or connected with the use of this Site or any of its content.

Reservations
You may be required to provide us with certain information in order to obtain access to, and use of, certain features and functions of the Services including, without limitation, your name or your company’s name, address, telephone number(s), e-mail address, and/or applicable payment data for orders placed for services (e.g. Credit Card Number, Security Code, and Expiration Date) (collectively, your “Information”). You represent, warrant and covenant to us that any and all information and any other information or data you provide to us, is and will be true, accurate and complete when given to us, that in providing such information to us you will not knowingly omit or misrepresent any material facts or information. You further consent and authorize us to verify your information as required for your use and access to the Services, as applicable. We agree to use this information in a manner consistent with our Privacy Policy, which can be viewed by clicking on the link entitled “Privacy Policy” accessible from the “Home Page” and at the bottom of this page. While we take steps to safeguard and prevent the unauthorized use and/or access to your private information, we are not responsible for the acts of those who may gain unauthorized use and/or access to prevent unauthorized use and/or access to the information. AM/PM Shuttle Service, LLC makes no warranty, expressed or implied, that we will be able to prevent unauthorized use and/or access to your private information. In no event will AM/PM Shuttle Service, LLC and its affiliates be liable or held responsible for any damages, whether consequentially, directly, incidentally, or indirectly arising out of any or in any way connected with a third party’s unauthorized use and/or access to your private information.

User Identification and Passwords
In order to access and use the Site, we may require you to enter a unique user ID and password. Your user ID, password, and any additional codes or passwords are collectively referred to herein as “IDs”. Your IDs are personal to you. You agree that you will not allow another person to use your IDs to access and use the Services under any circumstances.

You are solely responsible for maintaining the strict confidentiality of your IDs and for any charges, damages, liabilities or losses incurred or suffered as a result of your failure to do so. We are not liable for any harm caused by or related to the theft of your IDs, your disclosure of your IDs, or your authorization to allow another person to access and use the Services using your IDs. You agree to immediately notify us if you become aware of any unauthorized use of your IDs or other need to deactivate and ID due to security concerns.

Payment Policy
AM/PM Shuttle Service, LLC requires advance or pre-payment with a credit card at the time of reservation. There is no exception to this policy.

Limitations of Liability
AM/PM Shuttle Service, LLC is not responsible for delay in either customer pick-up or drop-off caused by weather, road or traffic conditions, mechanical failure (including mechanical failure of its vehicles), scheduling of its vehicles and/or drivers, natural disasters, or for any other conditions beyond its control. Any customer expenses arising as a result of such delayed arrival and/or departure of our shuttle vehicles(s), including customer expenses for missed flights and/or travel connections, shall be the sole responsibility of the customer. In any event, the Customer acknowledges and hereby agrees that the Company’s liability in any such event(s) shall not exceed the Customer’s cost of the trip to be performed by the Company.

Cancellation and Refund Policy
If you must cancel your reservation for any reason, AM/PM Shuttle Service, LLC requires that Customer provide at least 24 hours advance notice prior to scheduled pick-up time. If you do NOT call and cancel within the allowed time, or if you fail to show up at designated time, we will charge the full trip fee to the credit card provided upon making the reservation. If cancellation is made within the allotted time, a full refund will be provided.

Additional driver/vehicle wait time caused by delay in incoming flight, or excess luggage and/or baggage carried by Customer(s) may, at the sole discretion of the Company, result in additional charges being levied by the Company. These charges are due and payable before service(s) will be rendered.

Pick-Up Time
Although the Company may advise the Customer as to what an appropriate pick-up time may be, given the Company’s knowledge concerning the location and the distance to the destination, the route to be traveled, and likely traffic conditions, pick-up times are scheduled at the sole discretion of the Customer, and therefore late arrivals at the specific destinations(s), when such late arrivals are caused by late pick-up times, are the sole responsibility of the Customer.

Lost items
Many bags look alike, and our drivers cannot be responsible for remembering which bag(s) belong to each Customer(s). Upon reaching your destination, please ensure that you have retrieved all your belongings, and that each bag, briefcase, computer, etc. is indeed yours. Those items most often left behind include: cell phones, cameras, purses, small bags, and sunglasses. Customers are responsible for their personal possessions. We try our best to return items left in our vehicles to their owners, but we assume no liability for lost, stolen, damaged, or misplaced items.

Safety
The safety of our Customers is our highest priority. In order to maintain a safe and comfortable driving environment, our drivers have the right to deny and/or refuse service to (including de-board) any person who is the driver’s judgment,  is unruly, disruptive, poses a threat to the vehicle or any other person onboard, and/or does not comply with Company policy, rules and/or regulations.

Prohibited Items
The following are strictly prohibited items and/or behavior. Please note this list is not all inclusive, and AM/PM Shuttle Service, LLC reserves the right to add to or delete from this list.

• Possession and/or use of any weapons or items which can be implicitly used as a weapon
• Any item containing hazardous or corrosive materials (including, but not limited to: car batteries, fuel, flammable liquids, etc.)
• Any explosive/dangerous materials and/or devices
• Items that obstruct the aisles, disturbs other passengers, and/or take up another seat

Prohibited Activities
• Profanity
• Eating or drinking any substance on the vehicle (please take any and all medications before embarking or after debarking vehicle)
• Smoking, including electric cigarettes, or vapors
• Placing hands, feet, head, or any other parts of the body outside of the window
• Any act that can be construed as harassment or intimidation
• Any behavior that is considered by a reasonably intelligent individual to be: dangerous, disruptive, obscene, illegal, threatening, violent, or inciting
• Any and all insulting language and/or hand gestures

Prices
AM/PM Shuttle Service, LLC reserves the right to change its contractual livery rates for passengers and/or charters as reflected in its currently advertised rates or by private contract.

Gratuities
In most cases, our rates do NOT include a gratuity. Tipping is allowed and is much appreciated by our drivers.

Customer Liability
The Customer will be held financially liable for all damages caused to Company property during time of service.  A minimum cleaning fee of $300.00 will be charged to the Customer’s credit card for cleaning of vehicle (this includes, but is not limited to: vomit, body fluids, etc.). In addition, the Customer will be held financially responsible for any down time the vehicle may incur during such cleaning. Please note that our fleet vehicles are NO SMOKING and NO EATING OR DRINKING.

Employee Conduct
Our staff are expected to be professional, friendly, and courteous. Moreover, they are expected to abide by the same standards as our Customers. If you feel that one of our drivers or other staff has violated your rights, compromised your safety, or violated any rules described in this Agreement, please contact us. Whenever possible, please provide the driver’s name, vehicle number, and date/time of service. If the violation was committed by another staff member, please try to provide as much information as possible in order to identify the offending employee.

Also, please contact us in writing, via email or by telephone to offer suggestions, ways to improve our service, and to recognize an outstanding staff member.
